Do You Need a Domestic Payroll Service When Hiring a Caregiver Privately?
There’s a lot more to hiring a caregiver privately than finding someone Mom or Dad trusts.
For instance, you’ll need to manage their payroll and taxes as a household employee. Yep, you read that right. The IRS treats in-home caregivers as household employees, not independent contractors.
If, like many families, the paperwork is too much to handle, a domestic payroll service may be the solution. Below, we’ll share what a domestic payroll service is, how it can help you hire a caregiver compliantly, and how to find one to partner with.
You’re a Household Employer for Your Caregiver
When you hire a landscaper to mow your lawn using their own equipment, you’re paying an independent contractor for their services.
But when you hire a caregiver privately, have them perform services you outline, and use your supplies, you’re hiring a domestic employee. And that difference matters to the IRS.
Just as you are most likely a W2 employee for your employer, your caregiver needs to be a W2 employee of your household. You’ll need a Federal EIN (Employer Identification Number) to register your household as an employer, verify that your caregiver can work in the US and collect a W4 from them, and register with your state.
It is also your responsibility to withhold or pay taxes for your caregiver, pay unemployment taxes, and provide them with a W2 each year:
- Social Security and Medicare (FICA). These apply to household workers you pay $3,000 or more in cash wages. You pay 7.65% as the employer, and you can withhold the same amount from their pay. Or you can pay their share yourself and not withhold.
- Federal income tax. You aren't required to withhold it from a household employee. You only withhold if the employee asks and you agree.
- Federal unemployment (FUTA). This applies if you pay $1,000 or more in total household wages in any calendar quarter.
And don’t forget overtime pay, unemployment insurance, and workers’ compensation.
For most families, the benefits of hiring privately still outweigh the costs. Hiring privately gives you choice and control over who is in your home. If the responsibilities outlined above make you nervous, don’t worry. You can hire a domestic payroll service to manage the entire process.
What a Domestic Payroll Service Does
A domestic payroll service is a company that your family works with to compliantly hire and pay a caregiver. They help set up your household as a business and work with you to withhold, report, and pay your caregiver's Social Security, Medicare, federal unemployment, and income taxes.
In short, they take the paperwork and logistics off of your plate.
For example, one of our partners, HomeWork Solutions, has 30+ years of experience helping families manage and pay household staff compliantly. HomeWork Solutions assists families with the following:
- Applying for and receiving an EIN
- Tax account setup
- Calculating and processing pay
- Withholding and remitting payroll taxes
- Unemployment insurance compliance
- Maintaining payroll records and documentation
- Workers' compensation or other insurances
- Filing federal, state, and local tax forms
- Creation of year-end documents (such as W-2s, associated filings, and Schedule H)
You still get the benefits of hiring privately, without the headaches of managing IRS documents and endless paperwork. If you're already juggling a parent's appointments, medications, and bills, handing off the withholding math and the deadlines can be a real relief.
Why Getting Domestic Payroll Right Matters
What if your caregiver insists on being paid in cash? Is all this trouble really worth it?
Sure, paying them in cash would be easier, but then you’d be opening yourself up to tremendous risks, including:
- Legal consequences: This is the immediate one. Failure to properly classify and pay your caregiver can result in large IRS penalties or state fines.
- Lost benefits for the caregiver: Without taxes paid into the system, caregivers don’t receive Social Security or Medicare credits, or other state-level entitlements like paid sick leave.
- No protections for your family: Without a formal system, workers’ compensation claims, unemployment issues, and pay disputes become much harder to resolve and nearly never in the favor of the “employer”.
It doesn't take much for the IRS and/or state regulatory agencies to discover unlawful compensation arrangements and for those consequences to make their way to you. The risk to you is both real and significant.
Do You Really Need a Domestic Payroll Service to Manage This?
No, it’s not required. If you’re organized and well-versed in IRS documentation, you can do all of the above yourself. But that means you are responsible and liable for:
- Your caregiver’s tax withholdings
- Ensuring your caregiver receives a timely W2
- Managing unemployment and Workers’ Compensation on your own
And that, on top of a full-time job, managing a caregiver, and managing every other relationship in your life, is for most families far too big of a burden.
Fortunately, you do not have to manage this entirely on your own.
At LeanOnWe, we have years of experience matching families with the right caregiver, and we partner with experienced payroll advisors for domestic employment so you can pay your caregiver compliantly.
While our primary mission is to help you find the ideal caregiver for your unique needs, our service includes access to professional domestic payroll partners who can ensure you pay your caregiver legally and in compliance with all federal, state, and local laws.
Better to be smart than sorry!
